General Terms and Conditions for Tktxtattoos.uk

Article 1 – Definitions

In these General Terms and Conditions, the following terms shall have the meanings set out below:

  • Consumer: The natural person who is not acting in the course of a business or profession and who enters into a distance contract with Tktxtattoos.uk.
  • Entrepreneur: The legal entity or natural person who offers products and/or services remotely to consumers.
  • Distance contract: A contract concluded within the framework of a system organized by the entrepreneur for the remote sale of products and/or services, using exclusively one or more means of distance communication until the conclusion of the contract.
  • Right of withdrawal: The consumer’s right to withdraw from the distance contract within the withdrawal period.
  • Withdrawal period: The time frame during which the consumer can exercise the right of withdrawal.
  • Day: Calendar day.

Article 2 – Applicability

These General Terms and Conditions apply to every offer made by Tktxtattoos.uk and to every distance contract concluded between the entrepreneur and the consumer.

Before a distance contract is concluded, the consumer must have access to the text of these General Terms and Conditions. If that is not reasonably possible, Tktxtattoos.uk shall indicate how the terms can be accessed and that they will be sent to the consumer free of charge upon request.

If special conditions apply to a product or service in addition to these terms, both shall apply concurrently, and in case of conflict, the consumer may invoke the provision that is most favorable to them.

Article 3 – The Offer

Every offer made by Tktxtattoos.uk is non-binding. The entrepreneur reserves the right to modify or adjust the offer.

The offer must include a complete and accurate description of the products and/or services offered. The description must be detailed enough to allow the consumer to properly assess the offer. If Tktxtattoos.uk uses images, they must accurately represent the actual products and/or services. Obvious errors or mistakes in the offer are not binding.

Each offer must clearly state the rights and obligations associated with acceptance, including:

  • The total price including VAT;

  • Any applicable shipping costs;

  • How the contract is concluded and the steps involved;

  • Payment methods, delivery, and performance;

  • The time frame for accepting the offer or the period during which the price remains valid.

Article 4 – The Contract

Subject to the provisions of Article 4, the contract is concluded when the consumer accepts the offer and meets the specified conditions.

If the consumer accepts the offer electronically, Tktxtattoos.uk will immediately confirm receipt of this acceptance electronically. Until this confirmation is received, the consumer may cancel the contract.

If the contract is concluded electronically, Tktxtattoos.uk shall implement suitable technical and organizational measures to protect electronic data transmission and ensure a secure online environment. If electronic payment is possible, appropriate security measures will be taken.

Tktxtattoos.uk reserves the right, within the limits of the law, to verify whether the consumer can meet their payment obligations and any other factors relevant to responsibly concluding the distance contract. If there are valid reasons not to proceed, the entrepreneur may refuse the order or attach special conditions to its fulfillment.

Article 5 – Right of Withdrawal

The consumer may withdraw from a purchase contract within 14 days without providing any reason. Tktxtattoos.uk may ask for the reason, but the consumer is not obliged to provide it.

The withdrawal period begins the day after the consumer or a third party (other than the carrier) designated by the consumer has received the product.

If the contract concerns a service, the withdrawal period begins the day after the contract is concluded.

Article 6 – Consumer’s Obligations During the Withdrawal Period

During the withdrawal period, the consumer must handle the product and its packaging with care. The product may only be unpacked or used to the extent necessary to establish its nature, characteristics, and functioning.

If the consumer exercises the right of withdrawal, the product must be returned to Tktxtattoos.uk — including all accessories and, if reasonably possible, in its original condition and packaging — in accordance with the clear instructions provided by the entrepreneur.

The consumer is liable for any reduction in value of the product resulting from handling beyond what is permitted in this article.

Article 7 – Exercising the Right of Withdrawal and Costs

To exercise the right of withdrawal, the consumer must notify Tktxtattoos.uk in writing via the contact form or by email within the withdrawal period. After this notification, the consumer has an additional 14 days to return the product.

The product must be returned to the return address provided by Tktxtattoos.uk. The consumer bears the direct costs of returning the goods.

If the consumer has already made a payment, Tktxtattoos.uk shall refund the amount as soon as possible, but no later than 14 days after receiving the withdrawal notice.

Article 8 – Obligations of the Entrepreneur in Case of Withdrawal

If Tktxtattoos.uk allows electronic withdrawal notifications, an acknowledgment of receipt shall be sent to the consumer without delay.

Tktxtattoos.uk will refund all payments received from the consumer, including any delivery costs, within 14 days from the day the consumer notifies their withdrawal. However, the entrepreneur may delay the refund until the product has been received or proof of its return has been provided — whichever occurs first.

Article 9 – Exclusions from the Right of Withdrawal

Tktxtattoos.uk may exclude the following products from the consumer’s right of withdrawal:

  • Products made to the consumer’s specifications;

  • Products that deteriorate quickly or have a limited shelf life;

  • Sealed products which are not suitable for return for health or hygiene reasons if the seal has been broken;

  • Products that, after delivery, are inseparably mixed with other goods.

Article 10 – Price

The prices listed in the offer for products or services include VAT.

During the validity period stated in the offer, prices will not be increased except for changes due to VAT adjustments.

Price changes within three months of contract conclusion are permitted only if based on statutory regulations.

Article 11 – Performance of the Contract and Additional Warranty

Tktxtattoos.uk guarantees that the products and/or services comply with the contract, the specifications stated in the offer, reasonable standards of quality and usability, and legal requirements in force at the time of conclusion.

Any additional warranty offered by Tktxtattoos.uk, its supplier, manufacturer, or importer shall never limit the consumer’s statutory rights.

Article 12 – Delivery and Execution

Tktxtattoos.uk shall exercise the greatest possible care when receiving and executing orders and handling service requests.

The delivery address is the address provided by the consumer.

Subject to Article 4, accepted orders will be fulfilled promptly and within 30 days unless a longer delivery time has been agreed upon. In the event of a delay or partial inability to fulfill the order, the consumer will be notified within 30 days. The consumer may then cancel the contract without charge and may be entitled to compensation.

Upon cancellation under this article, Tktxtattoos.uk shall promptly refund any amounts paid.

Article 13 – Payment

Unless otherwise agreed, the consumer must pay within 14 days after the start of the withdrawal period, or, if no withdrawal period applies, within 14 days after contract conclusion.

In the case of product sales, the consumer cannot be required to pay more than 50% in advance. If prepayment is agreed, the entrepreneur is not obliged to execute the order before payment is received.

Article 14 – Complaints Procedure

Tktxtattoos.uk has an established complaints procedure and handles complaints in accordance with it.

Complaints regarding contract performance must be submitted in writing within a reasonable time after the defect is discovered and must be clearly described.

Complaints will be answered by the entrepreneur within 14 days. If more time is required, the consumer will receive an acknowledgment within 14 days, along with an estimate of when a more detailed response can be expected.

Article 15 – Retention of Ownership

All products delivered by Tktxtattoos.uk remain the property of the entrepreneur until the consumer has fulfilled all payment obligations under the contract.

The consumer may not pledge or otherwise encumber goods delivered under retention of title.

Article 16 – Additional Provisions

For certain products or services, additional conditions may apply. These will be clearly stated at the time of the offer.

In case of conflict between these General Terms and the additional conditions, the additional conditions shall prevail unless otherwise agreed.
